Legal proceedings GlaxoSmithKline is involved in various legal and administrative proceedings of a nature considered normal to its business, principally product liability, intellectual property and commercial cases and governmental investigations. Provision is made for anticipated settlement costs and associated legal and other expenses connected with legal disputes against GlaxoSmithKline where a reasonable estimate can be made of the likely outcome of the dispute. Legal proceedings in which GlaxoSmithKline is involved are described in the Annual Report 2000. Developments since the dates of the Annual Report and the Results Announcements for the first, second and third quarters of 2001 are set out below. In particular, GlaxoSmithKline is engaged in legal proceedings in the USA and Europe regarding infringement of the Group's patents related to Augmentin, Paxil Seroxat and Wellbutrin Zyban. In December 2001, a judge in the federal district court for the Eastern District of Virginia ruled on the validity of two patents covering Augmentin. The judge held one challenged patent expiring in 2002 valid, while a second expiring in 2018 invalid. This decision contradicted an issue as to validity ruled upon by the US Patent & Trademark Office in a re-examination of related GlaxoSmithKline patents. GlaxoSmithKline intends to appeal the District Court decision. The Group holds other patents covering Augmentin that expire in 2002 and 2017, and awaits a ruling by the same federal judge on similar challenges to those patents. GlaxoSmithKline is engaged in product liability litigation, including significant numbers of cases a number of which are purported class actions ; related to Fastin brand phentermine fen phen litigation ; , PPA decongestant products, vaccines containing thimerosal as a preservative, Baycol, Paxil and Lotronex. Additionally, GlaxoSmithKline is responding to government investigations in the USA into pricing, marketing and reimbursement of several prescription drug products. These investigations may involve related restitution or civil false claims act litigation on behalf of the federal or state governments. Proceedings have also been initiated against GlaxoSmithKline by various groups of private payers and the Nevada State Attorney General regarding similar pricing, marketing and distribution issues arising in the USA. Although the outcome of claims, legal proceedings and other matters in which GlaxoSmithKline is involved cannot be predicted with any certainty, the company's directors, having taken appropriate legal advice, do not expect the Group's ultimate liability for such matters, after taking into account provisions, tax benefits and insurance, to have a material adverse effect on its financial condition, results of its operations or cash flows. EXCHANGE RATES The results and net assets of the Group, as reported in sterling, are affected by movements in exchange rates between sterling and overseas currencies. GSK uses the average of exchange rates prevailing during the period to translate the results and cash flows of overseas Group subsidiary and associated undertakings into sterling and period end rates to translate the net assets of those undertakings. The currencies which most influence these translations, and the relevant exchange rates, are.

During the first three weeks she spent in Fairview Riverside Hospital in Minneapolis, Susan Endersbe, a 41-year-old woman struggling with schizophrenia and suicidal impulses, obtained care and medication that made her feel much better. Her mood lightened. By May 26, 1994, she was telling nurses that she felt she'd be ready to leave soon. But the very next day, she was referred to psychiatrist Faruk Abuzzahab, an encounter that put her on a path that led to her death. Abuzzahab, a past president of the Minnesota Psychiatric Society and onetime chairman of its ethics committee, had a contract with Abbott Laboratories to test the experimental antipsychotic drug Sertindole. What he earned has not been disclosed, but such contracts typically pay physicians much more than regular health insurance reimbursement, creating a powerful incentive to put patients into commercial research trials. Endersbe's death offers a peek into the financial side of corporate-funded research of new drugs for the mentally ill. While the development of new antipsychotic drugs has brought new hope for schizophrenic patients and allowed many to live successfully in the community, the clinical testing of these medications is also big business, with the pursuit of money often in conflict with good patient care. The result, in schizophrenia research, is a landscape tarnished by the greed of some rogue investigators and repeated instances of patients being harmed. ''The abuses are there, '' said Dr. Morris Goldman, associate professor of psychiatry at the University of Chicago School of Medicine, who investigated Abuzzahab's transgressions. ''A big part is the dollars involved. '' There are ''people drawn into this field because they are interested in dollars, '' Goldman added. ''They are very profit-conscious. And that combination of a lot of money, plus the added ethical dilemma you face in human research, that is a bad combination. And there are particular risks with psychiatric patients, with the whole issue of informed consent. It can really go wrong.'' and biaxin.

Some pedigree. The Canada courts have adopted a similar "patent" unreasonableness label within their pragmatic and functional framework; 169 Halsbury's has also adopted the phrase manifest unreasonableness as the heading for its discussion of irrationality or Wednesbury unreasonableness. 170 For the purposes of this standard, I suggest the purported iterations of Wednesbury which provide a similarly deferential standard ought to be amalgamated into this category. That is, the underpinnings of the logical fallacy approach applied in Erebus Royal Commission and separately classified by Baragwanath J in Tupou and Progressive Enterprises do not materially deviate from underpinnings of the standard and can readily be addressed in the methodology of the standard. 171 Identifying the distinct methodology is more difficult for this standard. Or, rather, articulating the methodology is difficult. It is easy to say this is one of the more deferential standards, but what does that really mean? Various linguistic terms have been adopted by the courts when applying the highly deferential standard. Phrases such as "so absurd that the decision-maker must have taken leave of his senses", 172 "so outrageous in its defiance of logic or of accepted moral standards that no sensible person who had applied his mind to the question to be decided could have arrive at it" 173 or "based on an evident logical fallacy". 174 To these phrases can be added the famous "irrationality" term a term though that has not been without its own criticism ; . 175 Two well-established principles should also be mentioned, as they have operated as important qualifications on judicial scrutiny of administrative discretion under this head. The contradistinction with a correctness standard has been applied universally, that is, it is not for the courts to substitute their view for that of the decision-maker. 176 Further, in terms of the relationship with the relevancy principle, weight to be given to relevant considerations remains a matter for the decision-maker; 177 this principle is usually expressed subject to the Wednesbury standard but it also colours the Wednesbury standard itself by suggesting highly deferential supervision of matters of weight and cardura.

BALB c mice were infected i.v. with 106 CFU of M. avium strain 2447 SmT through a lateral tail vein. At different time points, mice were sacrificed by cervical dislocation, and the organs spleen, liver, and lung ; were collected, homogenized, serially diluted in a 0.04% Tween 80 solution in distilled water, and plated onto Middlebrook 7H10 agar medium. The plates were incubated for 12 wk at 37C, and the number of CFU was counted. The data are expressed as the mean of the log10 number of CFU recovered per organ 1 SD n animals ; . Statistical significance of the differences was analyzed by performing the Student's t test using unpaired data.

B infection in the United States has decreased significantly among Caucasians, African Americans, and Hispanics over the past two decades 11 ; . Hepatitis B infection may cause HCC by several mechanisms including chronic infection and development of cirrhosis, integration of HBV DNA into host cells, and through the activity of a HBV-associated protein 3 ; . Studies of HCC in patients with chronic hepatitis B infection reveal that the severity of liver disease is the most important predictor of HCC risk in chronic carriers. Whereas the annual risk of developing HCC is less than 0.8% in patients with recurrent inflammation in the setting of chronic hepatitis B infection, the risk increases to between 1.5% and 6.6% in patients with cirrhosis 12 ; . A critical factor in the pathogenesis of chronic hepatitis B infection is the age of acquisition. Early age of infection increases the likelihood of chronic infection and thereby increases the risk of cirrhosis and HCC. In areas where chronic hepatitis B infection is endemic, the most common route of disease acquisition is vertically from mother to child at the time of birth. This mode of transmission is especially common in Asian populations. A second route, known as horizontal transmission, occurs when the disease is passed to a young child by contact with infected body fluids. Regardless of the route, early acquisition confers an increased likelihood of chronicity 13, 14 ; . In the United States, hepatitis B is most commonly acquired during adult life either by sexual transmission or through i.v. drug use. Health care workers also have a risk of acquiring hepatitis B through needle sticks and cuts sustained during the care of patients. Because health care institutions require that health workers receive vaccination for hepatitis B, this mode of transmission is becoming less common 13 ; . Infection through blood product transfusion is now rare because blood banks effectively screen blood donors for hepatitis B, hepatitis C, and HIV. Immunocompetent adults who acquire the infection have approximately a 95% chance of mounting protective immunity and eliminating the virus. However, in immunocompromised patients such as those with concomitant HIV infection, the likelihood of chronic infection increases. An effective campaign against hepatitis B must focus on various points in the natural history of the virus Fig. 1 ; . Perhaps the most important intervention is the prevention of chronic infection. Through childhood vaccination programs, the public health system in the United States has been success, for instance, makrolon.
A group of stockholders has filed a class-action lawsuit claiming damages against Bayer AG and certain current and former managers. The suit alleges that Bayer violated U.S. securities laws by making misleading statements, prior to the withdrawal of Lipobay Baycol from the market, about the product's commercial prospects and, after its withdrawal, about the related potential financial liability. Bayer believes it has meritorious defenses and will defend itself vigorously PPA: Bayer is a defendant in numerous product liability lawsuits relating to phenylpropanolamine PPA ; , which was previously contained in a cough cold product of the company supplied in effervescent-tablet form. The first PPA lawsuits were filed after the U.S. Food and Drug Administration recommended in the fall of 2000 that manufacturers voluntarily cease marketing products containing this active ingredient. Since that time, Bayer and other manufacturers of PPA-containing products, along with several retailers and distributors, have been named in numerous lawsuits in the United States brought by plaintiffs alleging injuries related to the claimed ingestion of PPA. Following the dismissal or withdrawal of many of these lawsuits, fewer than 850 cases remain pending against Bayer. Bayer is the sole defendant in approximately 550 cases and co-defendant together with other former manufacturers of PPA-containing products in approximately 300 cases. The majority of these cases are still at an early stage. Further dismissals are therefore possible, particularly should plaintiffs fail to comply with court orders requiring the submission of causative evidence. Currently, approximately 290 appeals have been filed by some of the plaintiffs whose suits were dismissed in the first instance on the grounds of procedural deficiency. Two PPA cases against Bayer have gone to trial so far. In the first case, in October 2004, a Texas jury awarded a plaintiff damages amounting to US$ 400, 000. Bayer will appeal this decision. In the second case, in February 2005 in Utah, the jury returned a verdict in Bayer's favor. Although Bayer plans to vigorously defend the majority of its PPA cases, there are cases where Bayer may consider settlement to be appropriate. To date, the company has settled several cases without acknowledging liability. Based on the relatively small number of pending cases in which adequate factual records have been developed to permit a meaningful assessment, a provision taking into account existing insurance coverage was established in and cefzil.
It can take a while to get an accurate diagnosis--and line up effective treatment--for kids with behavioral or learning problems. Here's what parents can do to hasten the process. Is it ADHD? A learning disability? Maybe it's depression or anxiety, a mild form of autism--or chronic fatigue resulting from a sleep disorder. Maybe it's a combination of things. Getting an answer to the question "What's wrong with my child?" can be harder than many parents expect. So can arranging appropriate treatment. In fact, experts say, the process of resolving a child's behavioral and academic problems is relatively straightforward for only about one in five families. Glenn Bevensee, of Northfield, New Jersey, counts himself among the lucky few. When the 47year-old father of two began to suspect that his 12-year-old daughter, Kristin, had ADHD, he consulted her pediatrician. As luck would have it, the doctor knew all about ADHD, in part because he had it himself. He was able to make an immediate diagnosis. "The pediatrician talked to my daughter for 10 seconds, " Glenn recalls. "He said, `Yep, we ADDers can spot others like us almost instantly.'" Fortunately, the medication prescribed by the pediatrician proved to be highly effective. Kristin was better within an hour. "Off medication, my daughter was obstinate and very loud, " says Glenn. "She raced around the house like a bull in a china shop. But once Kristin was on medication, her grades improved, she got her homework done, and she was much more pleasant to be around.

Contraindicated in patients with advanced cerebral arteriosclerosis. Due to its urotoxic effect, ifosfamide should not be administered without the use of a uroprotective agent such as mesna. Extra care is required in unilaterally nephrectomized patients, who are at increased risk of neurotoxicity due to accumulation of the toxic metabolite chloroacetaldehyde, and at increased risk of nephrotoxicity. Ifosfamide should not be given until 3 months after the nephrectomy. Ifosfamide has potential mutagenic, teratogenic and carcinogenic properties. Its safe use in pregnancy and its effect on fertility have not been established. In post-pubertal boys ifosfamide can cause irreversible gonadal damage resulting in sterility. Ifosfamide is excreted in breast milk, therefore breast feeding is not recommended.

To further characterise the biochemical properties of the M2-Vav interaction; 2 ; to investigate the biological significance of M2 binding to Vav in the context of MHV-68 infection in its natural host. To this end, our strategy is: 1. to determine the molecular mechanism of M2 induced phosphorylation of Vav; 2. to determine the functional sub-cellular localization of M2, including the generation of a MHV-68 recombinant virus encoding the M2 gene fused to a myrlstylation signal; 3. to assess the ability of MHV-68 to establish latent infection in Vav deficient mice; 4. to assess the capacity of MHV-68 recombinant viruses with mutated M2 genes that lack binding activity to Vav to establish latent infection in wild type mice; Given that Vav proteins play a crucial role in B cell differentiation and antigen triggered B cell activation, understanding how a virus modulates B cell function will not only contribute towards a better understanding of -herpesvirus pathogenesis but also potentially tell us how the immune system functions. | INCREASED PREVALENCE OF NEGATIVE LIFE EVENTS IN SUBTYPES OF MAJOR DEPRESSIVE DISORDER Yoav Kohn Dept. of Psychiatry, Hadassah-Hebrew Univ. Medical Center, Ein Karem, Jerusalem 91120, Israel Joseph Zislin, Ofer Agid; Bella Hanin; Tristan Troudart; Baruch Shapira; Miki Bloch; Eitan Gur; Michael Ritsner; and Bernard Lerer COMPR PSYCHIATRY, 42: 57-63, January February 2001 While it is well known that depressed patients experience more negative life events than normal subjects, there is little information available on the relationships if any ; between negative life events and specific subtypes of depression. To address this issue, the authors examined the frequency of negative life events in 115 patients with major depressive disorder MDD ; and 60 normal controls with no psychiatric history. Of the MDD patients, 76 66% ; reported experiencing at least one negative life event in the year prior to the onset of depression; only 18 controls 30% ; reported experiencing at least one negative life event in the year prior to interview. Significantly more patients than controls experienced at least two negative life events during this period 24% vs 8% ; . Patients reported marital difficulties, other personal problems, and medical events significantly more often than controls. Patients and controls did not differ in the severity they or the interviewer ; attributed to their negative life events. The two groups did not differ significantly with regard to the frequency of positive life events, although the control group tended to report the occurrence of at least one positive event and the occurrence of two positive events more often than the patient group. Younger MDD patients 50 years of age ; experienced four negative life events significantly more often than older MDD patients 50 years ; . A similar pattern emerged when the following subgroups were compared: patients experiencing their first depressive episode FDE ; and those with recurrent depression RDE mildly or moderately depressed patients and severely depressed patients; and patients with melancholic and nonmelancholic depression. FDE patients experienced four negative life events significantly more often than RDE patients. Nonmelancholic patients reported four life events significantly more frequently than melancholic patients. Mildly or moderately depressed patients reported the occurrence of three or four negative life events significantly more often than severely depressed patients. Other patient and illness characteristics such as gender, early parental loss, family history of depression or other mental disorders, psychotic features, suicide attempts, and chronicity were not related to increased prevalence of negative life events. The current results suggest that there is a subset of depressed patients who are especially prone to experience a cluster of negative life events. This subgroup patients under the age of 50 and suffering from their first, mild-to-moderate, nonmelancholic depressive episode ; may be at increased risk for relapse and poor prognosis. 17 References ; EAF.
3. Family Therapy focuses on helping the family function in more positive and constructive ways by exploring patterns of communication and providing support and education. Family therapy sessions can include the child or adolescent along with parents, siblings and grandparents. Couples therapy is a specific type of family therapy that focuses on a couple's communication and interactions e.g. parents having marital problems ; . 4. Group Therapy uses the power of group dynamics and peer interactions to increase understanding and improve social skills. There are many different types of group therapy e.g. psychodynamic, social skills, substance abuse, multi-family, parent support, etc. ; 5. Interpersonal Therapy IPT ; is a brief treatment specifically developed and tested for depression. The goals of IPT are to improve interpersonal functioning by decreasing the symptoms of depression. IPT has been shown to be effective in adolescents with depression. 6. Play Therapy involves the use of toys, blocks, dolls, puppets, drawings and games to help the child recognize, identify and verbalize feelings. The psychotherapist observes how the child uses play materials and identifies themes or patterns to understand the child's problems. Through a combination of talk and play the child has an opportunity to better understand and manage their conflicts, feelings and behavior. 7. Psychodynamic Psychotherapy emphasizes understanding the issues that motivate and influence a child's behavior, thoughts and feelings. It can help identify a child's typical behavior patterns, defenses and responses to inner conflicts and struggles. Psychoanalysis is a specialized, more intensive form of psychodynamic psychotherapy which usually involved several sessions per week. Psychodynamic psychotherapies are based on the assumption that a child's behavior and feelings will improve once the inner struggles are brought to light. Therapy is not a quick fix or an easy answer. It is a complex and rich process that can reduce symptoms, provide insight and improve a child or adolescent's functioning and quality of life. Child and adolescent professionals are trained in different forms of therapy and, if indicated, are able to combine these forms of treatment with medications to alleviate the child or adolescent's emotional and or behavioral problems. Therapy is a form of treatment that can help children and families understand and resolve problems, modify behavior, and make positive changes in their lives. There are several types of therapy that involve different approaches, techniques and interventions. At times, a combination of different therapeutic approaches may be helpful. In some cases a combination of medication with psychotherapy may be more effective.
